§1 Applicability to Business Clients and Definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional in nature (§ 13 BGB).

§2 Formation of Contract, Storage of Contract Text

(1) The following rules on contract conclusion apply to orders placed through our online shop at https://www.nergiz-grossmarkt.de/ & https://shop.nergiz-grossmarkt.de/home

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but is merely a non-binding invitation to the consumer to place orders. By placing an order for the desired goods, the consumer submits a binding offer to conclude a purchase contract.

Acceptance of the offer is made in writing, in text form, or by dispatching the ordered goods within one week. If the deadline passes without acceptance, the offer is considered rejected.

(4) Upon receipt of an order in our online shop, the following rules apply: The consumer submits a binding contractual offer by successfully completing the ordering process in our online shop.

The order is placed in the following steps:

1. Select the desired goods
2. Confirm by clicking the "Order" button
3. Review the details in the shopping cart
4. Click the "Proceed to checkout" button
5. Log in to the online shop after registering and entering login details (email address and password)
6. Review or correct the entered data once more
7. Bindingly submit the order by clicking the "Order with obligation to pay" or "Buy" button

Before submitting the order, the consumer can use the browser's "Back" button to return to the page where their details were entered and correct any mistakes, or close the browser to cancel the order. We confirm receipt of the order immediately with an automatically generated email (confirmation of receipt). This does not yet constitute acceptance of the offer. Acceptance occurs in writing, in text form, or by dispatching the ordered goods within one week.

(5) Storage of the contract text for orders via our online shop: We store the contract text and send you the order data and our GTC by email. You can also view the GTC at any time at https://shop.nergiz-grossmarkt.de/login. Your past orders can be viewed in the customer area under My Account → My Sent Orders.

§3 Prices, Shipping Costs, Payment, Due Date

(1) The stated prices include statutory VAT and other price components. Shipping costs may be added.

(2) The consumer may pay by prepayment (bank transfer).

(3) If the consumer has chosen prepayment, they are obliged to pay the purchase price immediately after conclusion of the contract.

§4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items we offer are ready for dispatch immediately. Delivery takes place within 5 business days at the latest. In the case of prepayment, the deadline begins the day after the transfer order is issued to the bank; for all other payment methods, the day after the contract is concluded. If the deadline falls on a Saturday, Sunday, or public holiday at the delivery location, it ends on the next business day.

(2) The risk of accidental loss and accidental deterioration of the sold goods passes to the buyer only upon handover of the goods, even in the case of mail-order sales.

§5 Retention of Title

We retain ownership of the goods until the purchase price has been paid in full.

§6 Right of Withdrawal for Consumers

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must notify us:

by means of a clear declaration (e.g. a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the sample withdrawal form below, though it is not mandatory.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for additional costs arising from your choice of a delivery method other than the cheapest standard delivery we offer), without delay and no later than fourteen days from the day we received your withdrawal notice. We will use the same means of payment for the reimbursement as you used for the original transaction, unless expressly agreed otherwise; no fees will be charged for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided proof of return, whichever is earlier.

You must return or hand over the goods without delay, and in any case no later than fourteen days from the day you notified us of your withdrawal. The deadline is met if you send the goods before the fourteen-day period expires.

You bear the direct costs of returning the goods.

§8 Warranty

The statutory warranty provisions apply.
